The following terms and conditions shall apply to the proposed lease of Property:
1. All bids must be in writing, signed by the individual or a representative of any corporate bidder. The outside of the envelope should be clearly marked "SEALED BIDS - LEASE PROPERTY" to indicate the purpose of the bid, so as to prevent accidental opening prior to the scheduled bid opening.
2. The successful bidder shall, within fifteen (15) days of the date of acceptance of the bid, enter into a contract with the City for the lease of the Property, in such form as is prepared by the City Attorney.
3. Any interested party wishing to inspect the Property prior to the submission of his/her bid may do so, during normal business hours, by contacting City Clerk Cathy Clerk (662-621-8136) to schedule an appointment. Submission of a bid shall be conclusive evidence of the bidder's prior inspection of the Property or his/her waiver thereof.
4. Lease shall occur within thirty (30) days from the date of execution of the contract.
5. The contract shall contain such other provisions as the City Attorney deems necessary and in the City's best interest.
6. The successful bidder will be required to pay cash or cash equivalent at the time of consummation of the lease.
The Board of the City will not open or consider any bid received after the hour on the date set forth above. The City reserves the right to reject any and all bids, and to waive any informalities in the bid process.

WHEREAS, on 13th day of March, 2013, Matthew Terrell executed a Deed of Trust to Don A.
