Resident Shoots Burglar
Police say a suspected burglar was shot in a southwest Clarksdale home earlier this month by the homeowner.
The Clarksdale Police Department said it was called to the 1000 block of Russwin Street, at 1:38 p.m. Thursday, Dec. 17 about a burglary in progress.
While en route, police said their units also learned that the suspected burglar was shot by the homeowner.
When officers arrived at the home they said they found both the resident and suspect, who was identified only as a black male, still on the scene. Police said the suspect in the burglary had been shot three times in the middle section of his body.
Officers also found what appeared to be an attempted forced entry into the home at the rear of the residence.
The suspect was transported to the hospital in Clarksdale by ambulance.
Police said there are no charges against the homeowner at this time but the Investigative Division is continuing to investigate both the burglary and shooting to determine what charges – if any – will be filed against the shooter and what charges might be filed against the suspected burglar.
Mississippi has a law that allows a person to use deadly force to defend themselves or their property, but there are situations where it doesn’t apply. That law went into effect in 2006.
The law does not prevent authorities with charging a shooter with a crime, but it does provide a defense in criminal court and a defense from civil liability.
The law is vague if the alleged intruder isn’t actually breaking in or if the shooter is not inside their home. If the shooter is not in their home, the law also raises questions of whether the shooter acted responsibly.
Police have asked anyone with information about these incidents to call the Clarksdale Police Department at 621-8156, Crime Stoppers at 1-800-222-8477 or simply dial 911. All calls remain anonymous and cash is paid to those providing information that leads to solving a crime.
